Congress should not reauthorize Section 702, the invasive spying program that sweeps up the emails, text messages, and other online communications of millions of innocent Americans. Congress should end the many years of overreach by the U.S. Intelligence Community (IC) and close warrantless “backdoor” access to data by allowing the law to sunset at the end of 2023. 

The constant bad news about how big tech companies intrude on our privacy illustrates the need for new laws to protect data privacy. A federal law should include, at minimum: No Preemption; Enforcement; Fairness; and Privacy Safeguards.

The Electronic Frontier Foundation submission to the consultation on the Practical Application of the United Nations Guiding Principles on Business and Human Rights (UNGP) to the Activities of Technology Companies. The first part of our submission focuses on the utility of the UNGP as a self-regulatory tool in assuring that social media content moderation practices are consistent with human rights principles. The second part focuses on the privacy and data protection implications of Extended Reality Technologies (XR), which include Virtual Reality (VR) and Augmented Reality (AR), contributing to session one, “Addressing human rights risks in business models.”

The First Amendment guarantees the public’s right to speak about court proceedings. Yet the Stored Communications Act currently allows the government to obtain court orders prohibiting the providers of electronic communications services from notifying their users when they receive law enforcement orders for user information pursuant to 18 U.S.C. Section 2703. These nondisclosure orders silence their recipients for any period that a court deems appropriate—even indefinitely—leaving the targets of the collection and the broader public unaware of the surveillance and unable to challenge it in court.

That’s why we recently sent a letter to the House Committee on the Judiciary in support of H.R. 7072, the NDO Fairness Act. This bill takes important steps toward bringing transparency and accountability to the federal government’s use of sweeping nondisclosure orders.

Bringing more transparency to government surveillance of individuals’ communications is a great step forward. We look forward to working together to enact these reforms.
