There is nothing like local action to get the attention of politicians and policy makers. The voice of constituents should speak loudest to the people who represent them. The goal of this toolkit is to make it easier for local groups to speak to their representatives in government.

When the legislature isn’t in session, senators and representatives are often back in their home states/districts. That means that you can show up to town halls and ask about issues. It also means you can set up in-person meetings to talk to them about your concerns.

Net neutrality is in an interesting place. The FCC repealed the 2015 Open Internet Order in 2017 and is had to defend its decision in court. That case is still pending. In 2018, the Senate voted to overturn the FCC’s repeal, but the House of Representatives did not. In 2019, the House of Representatives voted for the Save the Internet Act, which would make the 2015 Open Internet Order a law that the FCC cannot repeal. So now, once again, it is up to the Senate to stand up for net neutrality.

To that end, EFF has prepared a toolkit designed to help local groups and individuals take advantage of the fact that senators will be home while Congress is on recess. Groups can use these materials to set up group campaigns. We did a version of this toolkit last year, too, focused on getting the House of Representatives to reverse the FCC's decision. This year's guide has been revised to reflect that what we now need is for the Senate to pass the Save the Internet Act. How to Find a Town Hall or Set Up an In-Person Meeting With Your Representative

During recesses, senators are often back in their home states. You can see the full 2019 calendar here, but it shows that the Senate have the whole month of August off. That gives you the chance to interact directly with them and ensure they hear from your community—which is also their community—about net neutrality.

The first thing to do is to visit the websites of your senators. Those websites will have their office addresses and contact information, for both their offices in Washington, D.C. and in their home state. The local offices are a great resource during recesses, since they will know your representative’s schedule and the staff there will pass along what you said to the representative.

Town Halls:

One of the most powerful ways to talk to a member of Congress is to attend their town hall meetings and speak to them directly. These are announced through the member's online newsletter (which you can subscribe to by visiting their website) or your local paper.

Town Halls are typically announced 1 to 3 days before they are hosted, so you need to be vigilant. The local staff will often have advanced knowledge of their boss’ scheduled public events, so you can also call your local district office and ask.

Setting up in-person meetings:

If you are unable to attend a public event with your local elected official, then meeting with staff at the district office or in Washington, D.C., is a great alternative way. District offices can be more convenient for you—depending on how far Washington, D.C. is from you, and how much you can plan to travel.

Meetings can be set up at any time simply by calling the office. Just make sure you are calling the right office because they will only want to hear from the people they directly represent. When you make the call and set up the meeting be sure you tell them which organization you represent or if you’re a solo concerned citizen, where you live, and the issue you want to discuss.

Quality is important: the more personal the communication, the more impact it has on the elected official's thinking. You do not have to be an expert on an issue for it to matter to your representative. You just have to show that you care.

After your meeting, send a polite and gracious thank-you email to the person who met with you. In your email, be sure to include information that you want your representative to consider.

How to Talk About Net Neutrality and Counter Common Misconceptions

Three things to remember when talking about net neutrality:

  • Tell your story.
    • Why does net neutrality matter to you? Do you telecommute? No matter how simple the story, make it personal. 
  • Remind them that you represent the vast majority of Americans.
  • Net neutrality ensures that the Internet remains open and free, a level playing field when almost nothing else is.
    • If ISPs can engage in blocking, throttling, or paid prioritization, they can decide what speech gets seen and what doesn’t.
    • If the Internet is no longer a level playing field, new companies can’t compete with established Internet giants.
    • Voices that lack representation in traditional media depend on the Internet to spread their messages and organize.

Three common net neutrality myths and how to counter them:

  • “Net neutrality hurts ISP investment” – No, it does not.
    • Comcast, AT&T, Verizon, and Charter all admitted that the 2015 Open Internet Order did not affect investment and/or increased investment in 2016. In fact, investment has gone down since the repeal.
  • “The Save the Internet Act is a government takeover of the Internet” – No, it restores the protections of the 2015 Open Internet Order
    • At no point when it was in effect was the FCC able to dictate deployment, police speech online, or take over ISPs.
  • “The Internet didn’t collapse when the 2015 protections were repealed.” – No, but it has been worse.
    • We haven’t yet experienced the full ramifications of the repeal. But investment is down, and there’s been at least one major public safety incident that the old rules would have allowed an investigation into.

Remember to have a specific thing to ask for!

  • If you’re talking with one of your senators, ask them to vote for the Save the Internet Act.

Sample Letter to Your Representative

You can email your senators through EFF’s action. But if you’re looking to produce a letter on your group’s letterhead or your own action, here’s some sample text to use for net neutrality.

As your constituent, I'm writing in support of the Save the Internet Act.

As you know, in 2017, the FCC approved Chairman Ajit Pai's proposal to gut net neutrality protections. The FCC not only voted to reverse the 2015 order that treats broadband Internet service providers as common carriers under Title II of the Telecommunications Act, but also abdicated its established role in defending the open Internet altogether.

That decision cannot stand. It would give major telecommunications companies an unprecedented level of control over how we use the Internet. No agency would be able to effectively protect the public from unfair practices like site blocking, throttling, and slow lanes. Large cable companies claim to support the principles of net neutrality, but without a real regulatory cop on the beat backed by the authority of Title II, those claims are meaningless.

The Save the Internet Act would bring back the strong protections of the 2015 Open Internet Order by making them law. A free and open Internet is essential for a free society. I urge you to vote “yes” on the Save the Internet Act and support net neutrality. Protect my rights, not ISP profits

Sample Phone Script

f you want to run a campaign encouraging people to call their senators or call on your own or contact the local office about net neutrality, here's a sample script of what to say, both for asking others and calling yourself:

In 2017, the FCC voted to roll back the Open Internet Order, giving Internet service providers free rein to engage in unfair data discrimination practices. But Congress can make new net neutrality rules.

The Save the Internet Act takes the 2015 Open Internet Order and makes it the law of the land, meaning the FCC can never repeal net neutrality protections again. The House of Representatives has already done its part and voted to reinstate the net neutrality rules. Now we need the Senate to do the same. Please call Sen. ___________ and urge (him/her) to stand up for net neutrality.

It just takes a minute. All you need to do is call XXX-XXX-XXXX. When one of Sen. _______’s staff members answers the phone, just say, “Please urge Senator ________ to vote for the Open Internet Order.”

That’s it! The staff member will probably ask you for your name and some contact information. If you have time, you can also tell them why net neutrality is important to you—that it promotes an Internet where everyone can connect and speak out. You don’t have to be an expert, just be yourself.

Let’s make sure that Congress does the right thing. Let’s protect net neutrality

Media Tips

Spreading the word through Internet, print, television, and radio news outlets is a great way to engage your neighbors on net neutrality issues. You can get media attention a few ways: pitching to a reporter to get them to write about your issue, staging an event that is convenient for reporters to attend and cover, or writing an op-ed or letter to the editor.

Each one will help encourage members of your community to get attention to support the fight for net neutrality. But if you don’t interact with journalists the right way, you could waste a lot of time or worse, do more harm than good.

Three general tips:

  1. Use a news peg
    If you want to pitch a story or op-ed about net neutrality to the news media, it is helpful to have a newsworthy event or peg. Stay up-to-date on the news to see what topics, events, or public figures are getting significant coverage in the news, then look for ways to hook that coverage to net neutrality.
    Tying your pitch or op-ed to a specific event in the news—local, national, or international—is probably the most effective way to get news coverage. Reporters are often looking for ways to put an issue in context and advance it past what other news outlets are reporting. If you are planning an event, that can be the peg. If you are having a rally or a panel about net neutrality, for example, you can contact press about it.
  2. Go local
    Look at the websites for local and neighborhood radio, TV, newspapers, and popular blogs. Send text for a public service announcement to college radio stations, neighborhood newspapers, and your local news weekly.
  3. Always be prompt and professional
    Any interest you get from the press—be it a reply to something you sent or a reporter reaching out to you—should get a quick response. Answer any questions promptly and clearly. If you leave them hanging, you are telling them you are unprofessional and not worth following up with.

Pitching Stories and Events to Reporters

This section is adapted from EFF's Media Tips for Activists page. Many reporters prefer to receive pitches in email, as they can read them when they have enough time to digest the ideas. Keep it short, reporters get a lot of pitches. Example:

“Subject: Net neutrality is essential to local business success and keeping jobs in [your area].

Bob – I saw that you wrote about how technology is impacting small businesses and really enjoyed it.  So I thought you might be interested in another angle here, which is how losing net neutrality will hurt both consumers and innovation. My group works on these issues, and we have an expert who would love to talk about what’s going on right now: Incumbent telecoms working to weaken state net neutrality rules will threaten local businesses ability to reach [your state] residents and could result in reducing local employment opportunities and consumer choice. For example, the business you mention could become less accessible should Amazon and Target pay [local telecom giant] for preferred access to broadband providers. There’s more information here [URL to a blog post or something else on your website—not your home page!] Please let me know if you’d like to talk more.”

*** In your signature line, include complete contact information for yourself (with a title if you have one), and your organization.

Who do I pitch to?

  • Identify the reporters who have covered net neutrality, Internet, or technology issues and find their email addresses.
  • Always send an email to the general “news tip” email address that most outlets include on a “contact us” webpage as well.
  • Use BCC for added privacy when sending to a group of reporters.

Special notes for events:

Staging an event can be very effective. However, there are many things to keep in mind during the planning for this. Make sure that the event is at a convenient time and place for reporters to show up, ensure you have a good turnout from your team, and create strong visuals. There are more tips on staging events in this guide from the SPIN Project [pdf].

You should post a media alert on the web that includes the basics: title of the action, where, when, what reporters will see, and contact information for organizers and some links to more information (e.g., blog posts or other analysis as well as to the organizers’ home pages). Don’t put up too many graphics or over-design it—make it easy to read and understand.

If you emailed a reporter about an event and got no response, you may follow up with a phone call or email reminder about 24 hours before the start time if it's for broadcast. If you call, remember to ask whoever picks up the phone if they have time for your call, and then keep it short and to the point. For print or websites, follow up with a second, shorter email alert.

What happens when a reporter is interested?

If a reporter responds to your email, answer any questions promptly and clearly. Never imply that your email is an exclusive tip, unless it is. If a reporter asks who else you pitched it to, be honest. For example: “I sent out a similar email to a number of other reporters, but I’ve heard from you first. I think this story is very important and under-covered.”

What happens when I get no response, or a reporter has lost interest?

  • If you emailed a reporter in response to news coverage and got no answer, don’t resend the email. But you should feel free to try again when there’s a new story to respond to.
  • If reporters email you back to say some nice version of “thanks but not this time,” make a note of it. They are good reporters to email again when a new news peg comes up.
  • If reporters email you back to say “please don’t contact me again” or give other instructions for pitching stories, follow their directions.
  • In all your interactions with reporters, don’t get annoyed about not getting the response you want, and don’t spam them in frustration. Stay positive and email judiciously.

What to do when the press contacts you

  • You should have three points in mind that you’d like to make. Rehearse them, a lot. Make sure to get them in your answers. Think of three questions that you really don’t want to answer and rehearse your response to those as well.
  • Always assume that you are on the record and everything you say is going to be quoted. If that makes you speak slowly and deliberately, all the better—it will give the reporter time to take notes and get clarification.
  • If someone calls for a TV or radio interview, make sure to clarify if it will be live or taped, and what the reporter or interviewer expects of you. In case of a live show, feel free to ask for tips and helpful hints. Ask for questions in advance.
  • Often print/web reporters will ask to record the interview. Generally speaking, this is a good way to ensure that the reporter quotes you accurately. However, if the reporter does not broach the subject first, you should ask whether it will be recorded.

What happens after I see the story?

  • If you like it – or even if it’s just average or not so bad – send a follow up thank you email. Compliments don’t hurt either, if they are genuine.
  • Do follow up later with any new developments that you think might interest the reporter. But don’t overdo it, or you will find you’ll soon be ignored.
  • If there are elements of the story that you don’t like, you can clarify politely in your thank you message. This is a good way to get corrected spellings, etc., into web copy, for example. It happens much faster if you are cheerfully pointing something out than if you angrily demand a correction.
  • Only ask for a correction if there is a clear, factual error (e.g., names, dates, numbers, laws, misquotes). Done politely, this will not sabotage future coverage and may in fact nurture a better relationship of trust. What you do not want to do is attack the angle, interpretation, perception, balance, or characterization. Basically, you shouldn't start an argument about something that is a matter of opinion.
  • Once you start arguing with a reporter about his or her accuracy and ability to tell a story, you could easily ruin the relationship. Ask yourself: Is this change worth sabotaging all future coverage? Am I being oversensitive? Remember that you can’t control media coverage. Looking imperfect is sometimes the price of admission. However, the public opinion gains that you can make with media coverage usually make the risk worth it.

Placing Op-Eds and Letters to the Editor

Where do I send these?

Most often, your local paper will have a page that tells you how to submit a letter to the editor or an op-ed. If you can’t find one, politely email the opinion editor and ask about requirements and word limit. Their contact information should be findable on the paper’s website, on the opinion page, about page, or a page labeled “masthead.”

Make sure to find and follow directions

Whether you get the instructions from a webpage or from emailing the editor, make sure you follow them exactly. Especially the word count. For example, the San Francisco Chronicle limits letters to the editor to 200 words and “commentary” to 700.

Identify a local angle

How net neutrality affects your community is a unique perspective you can add to the debate and get attention from your representatives and press

  • Did the local paper have a recent story on net neutrality? Include it in your writing. It shows the paper that the public is responding to their work, which they like to see.
  • Try to also put a local spin on the issue. Is there a local villain or hero? Is a local official involved in a particular way? Has a local political figure said something about the issue you can include?
    • You may live somewhere that only has one ISP or relies on telecommuting or remote medicine. That is why net neutrality has an impact on your community.

Make one or two points well

  • The word limit means you won’t have space to get into everything you want, so think about the one to two most important points you want to make.
  • The local and/or timely angle you’ve identified first can help you frame the rest of it.

Put your best foot forward first

Your first paragraph should be short and punchy. The following paragraph should outline your most compelling point or example. This will get the attention of the editor looking at your submission and the readers.
