The STOP CSAM Act of 2025 (S. 1829) risks weakening digital security and opening the door to private lawsuits against services that use encryption. It’s the wrong tool for combating child exploitation online.
Federal law already makes it a crime to possess, distribute, or promote child sexual abuse material (CSAM). Platforms with actual knowledge must report it to the National Center for Missing and Exploited Children or face serious criminal and civil penalties under 18 U.S.C. § 2258A. Knowing about CSAM and doing nothing is not legal under current law.
The bill allows encrypted services to raise a legal defense—but only after they’ve been sued. That's not good enough. STOP CSAM will require encryption providers to defend against costly lawsuits over content they can't see or control. And a jury could still consider the use of encryption to be evidence of wrongdoing.
Even if a platform ultimately prevails in court, the accusation of facilitating child abuse will do irreparable damage to its public reputation and user trust. Americans’ private, secure communications will be put on trial, over and over again. That’s bad for everyone—including children, domestic violence survivors, and national security.
Current law has strict reporting requirements about CSAM. It creates new legal exposure that invites speculative lawsuits, even against apps and websites that are working in good faith to fight abuse. It could damage smaller platforms, reduce competition, and drive encrypted apps out of the U.S. market, without meaningfully advancing child protection.

Deceptive AI-generated replicas can cause real harms, such as leading the public to think an individual has endorsed a product or engaged in unsavory conduct. In many cases, however, the use of a replica—in news articles, commentary, art, and so on—is First Amendment protected speech. Existing law addresses many harms caused by deceptive images, balancing competing interests as needed. But Congress may consider targeted, proportionate fixes to fill in any gaps.
The NO FAKES Act, however, is neither targeted nor proportionate.
NO FAKES Act creates an expansive new federal intellectual property right that allows companies or individuals (or their heirs) to sue anyone who makes or shares an image they don’t like, or builds products and services that help others do so.
NO FAKES is an overbroad bill that is ripe for abuse.

Concerns with Children and Teens’ Online Privacy Protection Act (S.836) |

The Electronic Frontier Foundation (EFF) writes to share our concerns with the current text of the Children and Teens’ Online Privacy Protection Act (S. 836).1 While we admire the sponsor’s longstanding commitment to protecting the privacy of children and adults and we believe the goals of the bill are laudable, we are concerned that the current version of the legislation would have some unintended consequences that could ultimately jeopardize the same people the bill seeks to protect. Therefore, EFF suggests a change to the bill as the Committee begins consideration.
EFF applauds that the bill provides greater privacy protections to more young people than under the current law, by increasing the age of the covered user from under 13 to under 17. This bill also recognizes that teens need some amount of privacy and autonomy by allowing children between 13-16 to consent to data collected for commercial purposes, rather than requiring those teens to get their parents’ consent.
However, the bill’s big change from current law is likely to result in increasing privacy and security risks for young people online. Under COPPA, a service must obtain verifiable parental consent before collecting personal information from children under 13 if it either (1) directs its services to children or (2) has actual knowledge that the user is a child. The bill would amend the actual knowledge standard to a much lower standard: “knowledge fairly implied on the basis of objective circumstances”3 is defined for purposes of the bill as “whether a reasonable and prudent person under the circumstances would have known that the user is a child or teen.”
We oppose this change because we fear online services will implement burdensome and privacy invasive age-verification gates to comply with the bill's lower knowledge standard. The bill's “knowledge fairly implied” standard is essentially a negligence standard, which is one of the lowest mental standards recognized by law.
EFF continues to advocate for comprehensive consumer data privacy legislation, for Americans of all ages, which would protect all users’ privacy without also implicating the free speech rights of adults. At minimum, Congress should not incentivize general audience websites to go in the opposite, privacy-invasive, direction.

The American Civil Liberties Union, Center for Democracy & Technology, Electronic Frontier Foundation, and Electronic Privacy Information Center jointly submit this Statement For The Record to the Senate Judiciary Committee regarding counter unmanned aerial system (“C-UAS”) authorities.
We hope Congress will take effective action on this important issue. However, it must do so in a careful manner that protects privacy and civil liberties, as well as addressing public safety concerns. We urge Congress to only extend C-UAS authorities with the limits described in this document to help ensure that counter-drone authorities are wielded responsibly.

The TAKE IT DOWN Act seeks to speed up the removal of certain kinds of troubling online content, but lacks necessary safeguards to protect free expression, user privacy, and due process. While the bill is meant to address a serious problem—the distribution of non-consensual intimate imagery—the notice-and-takedown system it creates is an open invitation for powerful people to pressure websites into removing content they dislike.
President Trump has shown just how this system can be abused, saying earlier this year in a joint address to Congress that he would personally use the takedown provisions to censor speech critical of the president. The TAKE IT DOWN Act is the wrong approach to helping people whose intimate images are shared without their consent. We can help victims of online harassment without embracing a new regime of online censorship.

The internet allows people everywhere to connect, share ideas, and advocate for change without needing immense resources or technical expertise. Congress recognized that for user speech to thrive on the internet, it had to protect the services that power users’ speech, from email to Yelp to Etsy to Reddit.
Without Section 230’s protections, many online platforms would intensively filter and censor user speech, while others may simply not host user content at all. Section 230’s balanced legal and policy framework allows the internet we know to exist. Congress should not change it.

The Electronic Frontier Foundation (EFF) writes to reiterate our opposition to the Strengthening Transparency and Obligation to Protect Children Suffering from Abuse and Mistreatment Act of 2023 (STOP CSAM Act). We opposed the original version of the STOP CSAM Act in the previous Congress, and we are concerned to see the Committee moving to consider the same flawed ideas in the current Congress. While we appreciate the robust conversations we’ve had with the staff of the sponsors of the bills, our concerns remain.
We understand that the sponsors of these bills say their legislation is intended to protect children from online sexual exploitation—an important and laudable goal. But laudable goals do not always make good law. We urge the Committee to find a different way to address this problem.
