Does U.S. Secret Law Threaten Our Democracy?

Since the beginning of the War on Terror, the Department of Justice has increasingly relied on opinions drawn up in secret by the Office of Legal Counsel (OLC) to justify policies including extraordinary rendition, the use of torture, the killing of Americans abroad, searches under the Patriot Act, and warrantless wiretapping under the FISA Amendments Act.

EFF senior counsel David Sobel will join the New York Times' national security reporter Charlie Savage and ACLU deputy legal director Jameel Jaffer for a thought-provoking discussion on whether and when the government is justified in keeping OLC opinions secret. The panel will be moderated by CREW Chief Counsel Anne Weismann.
