US v. Pool

The forced collection of DNA samples from arrestees without search warrants violates their Fourth Amendment right to privacy, the Electronic Frontier Foundation told a federal appeals court in an amicus brief filed in July of 2011.  However, shortly before this case was to be heard in the Ninth Circuit, the defendant pleaded guilty and the case was dismissed.
