The Electronic Frontier Foundation (EFF) is seeking an experienced racial justice litigator to join our legal team and assist in working up and leading impact litigation at the intersection of civil rights, civil liberties, and technology.
For more than 25 years, EFF has been on the leading edge of litigating civil liberties issues in the rapidly evolving Internet age. In so doing, EFF has played a substantial role in the developing the law that applies to the modern Internet and digital environments.
Much of our current legal work – combatting surveillance by both the federal national security apparatus and local law enforcement, protecting the rights to speak, associate, and protest online – seeks to vindicate rights that have special resonance with vulnerable communities that are frequently targeted by the practices we challenge, and subject to discriminatory enforcement. For example, our work on artificial intelligence seeks to challenge the use of systems with built-in bias and the opacity shrouding their use. Through our work on street level surveillance, we aim to challenge disparate impacts of the use of surveillance technologies. There are many other issues to pursue with current technology, and many more others that will arise in the future.
EFF wants to add racial justice and civil rights expertise to our existing legal team with the goal of being more pro-active in bringing racial justice and civil rights cases stemming from these and similar practices by both governments and large, powerful, private actors. Although this is first and foremost a litigation position, non-litigation responsibilities may include advocacy, public speaking, blogging, media appearances, and work on legislative and regulatory matters related to surveillance and law enforcement.
- 5 years of lawyering experience, with at least 3 years of experience playing an active role in litigating racial justice issues in Section 1983, Bivens, and similar civil rights cases.
- Experience working with vulnerable communities, such as communities of color, immigrant communities, Muslim American communities, and/or LGBTQ communities.
- Strong legal and non-legal writing and analytical skills, as well as the ability to be self-motivated and focused
- Good communication skills and an interest in working with a team of highly motivated lawyers and activists in a hard-working nonprofit environment.
Helpful but not required:
- Experience with First and Fourth Amendment law.
- Tech savviness and a familiarity with high tech public interest issues is not required, but applicants should have an interest in developing such expertise.
This position is based in San Francisco. Because we like working together and gain much from our daily personal interactions, remote workplaces will not be considered.
