The Electronic Frontier Foundation (EFF) has decided to throw its weight into the situation, stating its intention to argue before the United States Patent and Trademark Office (USPTO) on Dec. 17. The EFF has been a vocal critic of Personal Audio for more than a year, having launched a “Save Podcasting” campaign in May of 2013, designed specifically to respond to Personal Audio. Buoyed by support from its members and the podcasting community, EFF filed a petition challenging five claims of U.S. Patent No. 8,112,504 in October 2013.
The hearing will be open to the public, and the EFF plans to argue that Personal Audio’s patents should be ruled invalid because they do not pass the obviousness test.
