A U.S. lawsuit is asking the court to restrict online access to more than one million books available to the public from the Internet Archives. The U.S. suit alleges that the Internet Archives engaged in “willful mass copyright infringement,” when it asserts that it used a practice called Controlled Digital Lending (CDL) which allows the circulation of works in a digital—as opposed to physical—format, in a controlled manner. The legal status of CDL is also controversial outside the U.S.

Panelists—EFF Legal Director Corynne McSherry, Luis Gil Abinader, Manon Ress, Teresa Hackett, and Luis Villarroel Villalón— —will discuss (1) the legal issues, (2) the technology used for CDL, (3) the practices that determine access, (4) how this relates to a pandemic, when schools and libraries are either closed or less accessible, and (5) the facts regarding usage of such systems, including by the Internet Archives, but also by other more traditional libraries and educational institutions.
